轉知教育部函釋關貴校專任教師得否擔任與校務發展業務無涉之財團法人基金會無給職董事兼執行長一案。

 

說明：

一、依據教育部 106 年 1 月 19 日臺教人(二)字第 1050180472 號函辦理。

二、檢附教育部原函影本 1 份。

有關公立學校專任教師兼任非以營利為目的之事業或團體之職務規範如下：

（一）兼任行政職務專任教師：公務員除法令規定者外，不得兼任他項公職或業務；兼任教學或研究工作，應經服務機關之許可（機關首長應經上級主管機關許可）；兼任非以營利為目的之事業或團體之職務時則應視其是否受有報酬，分別依公務員服務法第 14 條之 2 或第 14 條之 3 規定辦理－亦即均須經服務機關審酌實際情形及相關規定許可之（機關首長應經上級主管機關許可）。

（二）未兼任行政職務專任教師：依教師兼職處理原則規定，教師如擬至合於民法總則之財團法人兼職，學校應考量該兼職是否與教師教學或研究專長領域相關、兼職時數每週合計不得超過 8 小時、是否影響本職工作等因素，秉權責審酌准駁。另依該原則第 9 點規定，教師之兼職有所列 10 種情形之一者，學校應不予核准；及該原則第 12 點規定，各級主管教育行政機關或學校定有更嚴格之規定者，從其規定。
