一、依據教育部國民及學前教育署 103年 10 月 24 日臺教國署國字第 1030113376 號函辦理。

二、幼兒園教保服務實施準則(以下簡稱教保準則)第13條規定：「幼兒園實施教保活動課程，應依下列規定為之：一、每學期應至少召開一次全園性教保活動課程發展會議。二、訂定行事曆、作息計畫及課程計畫。三、落實健康教育、生命教育、安全教育、品德教育及性別平等教育。四、以統整方式實施，不得採分科方式進行。五、以自行發展為原則，並應自幼兒生活經驗及在地生活環境中選材。六、有選用輔助教材之必要時，其內容應符合幼兒園教保活動課程大綱之精神。七、不得採全日、半日或分科之外語教學。八、不得進行以精熟為目的之讀、寫、算教學。」

三、另依幼兒教育及照顧法(以下簡稱幼照法)第52條第1項第2款規定略以：「幼兒園有下列情形之一者，應令其限期改善，屆期仍未改善者，處幼兒園負責人新臺幣三千元以上三萬元以下罰鍰，並得按次處罰，其情節重大或經處罰三次後仍未改善者，得為減少招收人數、停止招收六個月至一年、停辦一年至三年或廢止設立許可之處分：...。二、違反依第十二條第二項所定準則有關幼兒園之教保活動、衛生保健之強制或禁止規定。...。」

四、為維護幼兒身心正常發展，請各幼兒園落實教保準則相關規定，經查如有違反上開教保活動之強制或禁止規定之情事者，將依幼照法第52條辦理。
