原住民族委員會原住民族傳統智慧創作專用權登記總表 1 份(如附件)，請詳閱所屬依原住民族傳統智慧創作保護條例並依規定辦理，說明：
一、依據原住民族委員會 110 年 11 月 2 日原民經字第 1100065160 號函辦理。
二、原住民族傳統智慧創作保護條例(下稱傳智條例)第 7 條規定已取得登記公告智慧創作專用權者，如旨揭總表所列。
三、智慧創作之使用，應依下列規定辦理：
(一)傳智條例第 10 條規定略以，智慧創作專用權可分成智慧創作人格權及智慧創作財產權，就前者，智慧創作專用權人，專有公開發表、表示專用權人名稱、禁止他人以歪曲、割裂、竄改或其他方法改變其智慧創作之內容、形式或名目致損害其名譽等人格權；就後者，專用權人除法律或契約另有規定外，應以特定民族、部落或全部原住民族名義，專有使用及收益其智慧創作之財產權。
(二)傳智條例第 13 條規定略以，專用權人得將財產權授權他人使用，授權使用之地域、時間、內容、使用方式或其他事項，依當事人之約定，如係專屬授權，應由各當事人署名，檢附契約或證明文件，向原住民族委員會申請登記。
(三)傳智條例第 16 條規定略以，下列情形得使用公開發表之智慧創作，惟應註明出處：
１、供個人或家庭為非營利之目的使用者。
２、為報導、評論、教育或研究之必要使用者。
３、為其他正當之目的，以合理方法使用者。
四、已審定之智慧創作內容及相關資訊，得逕至原住民族傳統智慧創作保護資訊網(http://www.titic.cip.gov.tw/)查詢，或電洽該會業務單位(02-89953955)。
