一、依據教育基本法、公務人員行政中立法等相關規定辦理，本局 110 年 10 月 26 日南市教人（一）字第 1101249829 號函諒達。
二、查本局 110 年 10 月 26 日函規定意旨，學校公教人員應依教育基本法、公務人員行政中立法等規定嚴守教育及行政中立。
三、次查教育基本法第 6 條規定：「教育應本中立原則。學校不得為特定政治團體從事宣傳或活動。主管教育行政機關及學校亦不得強迫學校行政人員、教師及學生參加任何政治團體或活動。」
四、復查公務人員行政中立法第 9 條規定：公務人員不得為支持或反對特定之政黨、其他政治團體或公職候選人，或動用行政資源印製散發從事下列政治活動或行為：
(一)動用行政資源編印製、散發、張貼文書、圖畫、其他宣傳品或辦理相關活動。
(二)在辦公場所懸掛、張貼、穿戴或標示特定政黨、其他政治團體或公職候選人之旗幟、徽章或服飾。
(三)主持集會、發起遊行或領導連署活動。
(四)在大眾傳播媒體具銜或具名廣告。但公職候選人之配偶及二親等以內血親、姻親只具名不具銜者，不在此限。
(五)對職務相關人員或其職務對象表達指示。
(六)公開為公職候選人站台、助講、遊行或拜票。但公職候選人之配偶及二親等以內血親、姻親，不在此限。
五、再查臺南市各級學校校園場地使用管理辦法第 6 條規定略以，「依公職人員選舉罷免法及總統副總統選舉罷免法之競選或罷免活動及懸掛或豎立標語、看板、旗幟、布條等競選或罷免廣告物，管理機關得不予核准使用；核准後始發現者，得停止其校園場地之使用。」請各校確實依上開規定落實校園場域管理。
六、茲因選舉將屆，為維護校園學習環境安寧，請學校利用各種集會及相關教學機會，向教職員工宣導民主法治及淨化選舉風氣之理念，避免違反教育及行政中立。
