主旨：銓敘部民國 75 年 3 月 24 日 75 台華特一字第 07130 號函及 84 年 9 月 25 日 84 台中特三字第 1196604 號函有關公務人員因公撫卹之規定，自即日起停止適用，請 查照。
說明：
一、依據本府人事處案陳銓敘部 102 年 12 月 19 日部退四字第 1023687742 號函辦理，檢附原函影本 1 份。
二、公務人員亡故得否辦理因公死亡撫卹事宜，以及公務人員因公死亡情事之認定，於 100 年 1 月 1 日修正施行之撫卹法令已重行規定，爰銓敘部旨揭 75 年 3 月 24 日函所定「公務人員被選派參加非政府機關所舉辦之各項運動，於比賽期間因猝發疾病，或發生意外，以致死亡，准依撫卹法第 5 條第 1 項第 3 款之規定予以因公死亡撫卹」及 84 年 9 月 25 日函所定「公務人員無照騎機車送公文往返途中，發生交通事故死亡，准依撫卹法第 5 條第 1 項第 2 款之規定辦理因公死亡撫卹」，均與現行撫卹法之規定不符。爰該二函示規定均自即日起停止適用。
