主旨：「家庭暴力防治法部分條文修正案」業奉總統公布(如附件，其中第63條之1，自公布後一年施行)，請貴校配合辦理，請查照。
說明：
一、依據教育部104年3月10日臺教學(三)字第1040030238號函，及本府104年3月24日府社家字第1040295343號函辦理。
二、旨揭法案與學校相關之修正部分如下，並請列入宣導項目：
(一)第2條新增目睹家庭暴力、騷擾及跟蹤之定義。
(二)第14條將目睹暴力之兒童及少年列入保護令保護範圍。
(三)第59條第3項修正將幼兒園之輔導人員及教保服務人員列為教育主管機關應辦理防治家庭暴力在職教育之對象。
(四)第60條將每學年應實施4小時以上之家庭暴力防治教育課程之「各級中小學」修正為「高級中等以下學校」。
(五)第63條之1新增，被害人年滿十六歲，遭受現有或曾有親密關係之未同居伴侶施以身體或精神上不法侵害之情事者準用相關法條之保護，並列入「親密關係伴侶」之定義。
三、上開第63條之1新增條文於未施行前，學校知悉學生因情感事件致生人身安全之顧慮時，倘屬性別平等教育法（以下簡稱性平法）第2條所定之疑似校園性侵害、性騷擾或性霸凌事件者，應交由學校所設性別平等教育委員會調查處理，並研議相關輔導及保護措施。非屬性平法適用之事件，得透過學校學務與輔導處室之討論，研擬對該事件之危機因應、保護或輔導措施，以維護學生之人身安全。必要時並得協助學生向警方報案，由警方依據社會秩序維護法、刑法等相關法律進行後續處理。
