主旨：轉知教育部函釋，教師得視需要合併性別工作平等法第 18 條規定之哺乳時間為每日 1 次，每次以 1 小時為度，請 查照。
說明：
一、依教育部 104 年 4 月 7 日臺教人(三)字第 1040036575 號函。
二、查性別工作平等法（下稱性工法）第 2 條規定：「（第 1 項）雇主與受僱者之約定優於本法者，從其約定。（第 2 項）本法於...教育人員...，亦適用之。...」同法 18 條規定：「（第 1 項）子女未滿 1 歲須受僱者親自哺乳者，除規定之休息時間外，雇主應每日另給哺乳時間 2 次，每次以 30 分鐘為度。（第 2 項）前項哺乳時間，視為工作時間。」
三、次查原行政院勞工委員會（現為勞動部） 93 年 3 月 17 日勞動三字第 0930012452 號函略以：「...查兩性工作平等法（現為性別工作平等法，簡稱性工法）第 18 條之規定，旨在使受僱者得以兼顧工作與育兒，如受僱者確有親自哺乳之需要而提出申請，雇主應依法給予。至於勞資雙方協商約定將哺乳期間集中一次申請，自無不可，惟哺乳時間仍應含在當日正常工作時間內。...」
四、綜上，參酌性工法規定之哺乳時間，旨在使受僱者得以兼顧工作與親職，並得視需要由勞雇雙方協商議定哺乳時間，爰同意學校教師得與服務學校協商約定，視需要合併性工法第 18 條規定之哺乳時間為每日 1 次，每次以 1 小時為度。
