主旨：轉知教育部函釋教師職前曾任「建教合作計畫按月支薪專任助理人員」、「行政機關按月支薪臨時人員」及「充實行政人力按月支薪約用人員」等服務年資得否採計為休假年資疑義一案，請查照。
說明：
一、依教育部 104 年 9 月 23 日臺教人(三)字第 1040119125 號函辦理。
二、有關兼任行政職務教師休假年資之計算，除依教師請假規則第 8 條第 1 項規定專任教師年資得併計核給，及教育部歷來同意專任教師兼任行政職務採計職前年資併計休假年資之函釋外，依教師請假規則第 8 條之立法意旨，教師兼任行政職務者，以其所兼行政職務，有公務員服務法之適用，爰於該條第 1 項明訂教師之休假以兼任行政職務之教師為限，是以，援例均參酌銓敘部有關公務人員休假年資採計之函釋規定辦理。
三、查銓敘部 102 年 4 月 11 日部法二字第 1023716582 號書函規定略以：「...臨時人員轉任公務人員擬併計臨時人員年資核予休假，須符合（一）政府機關（構）、公立學校本於權責以全職專任性質進用；（二）按月支薪；（三）薪資來源全數來自政府預算（指依預算法規定之預算經費項目，其無論係單位預算或附屬單位預算＜含特種基金＞，如依預算法規定籌劃、擬編、審議及執行等程序者，始屬政府預算經費；至於各機關自行籌措管理，未依上開程序辦理之各項經費，縱使名稱為基金或委辦費科目，仍非屬上開政府預算經費）等要件。…。」。
四、綜上，有關教師職前曾任「建教合作計畫按月支薪專任助理人員」、「行政機關按月支薪臨時人員」及「充實行政人力按月支薪約用人員」等臨時人員年資得否併計休假年資計算，請服務學校本於權責，參酌上開銓敘部函釋規定並查明個案事實後認定辦理。
