主旨：有關兼任行政職教師於學年終分娩，因尚餘休假日數，基於休假按學年結算原則無法保留於次學年實施，可否先請畢休假，再續請娩假日數之疑義一案，請查照。
說明：
一、依教育部 104 年 10 月 6 日臺教人(三)字第 1040127935 號函辦理。
二、查教師請假規則第 3 條第 1 項第 4 款規定：「因懷孕者，於分娩前，給產前假 8 日，得分次申請，不得保留至分娩後；於分娩後，給娩假 42 日；...。娩假及流產假應一次請畢，且不得扣除寒暑假之日數。分娩前已請畢產前假者，必要時得於分娩前先申請部分娩假，並以 21 日為限，不限一次請畢。...。」，第 8 條第 1 項規定：「公立中小學教師兼任行政職務者，應給予休假，其專任教師年資得併計核給，服務年資滿 1 學年者，自第 2 學年起，每學年應給休假 7 日；…。」，第 11 條規定：「（第 1 項）教師符合第 8 條休假規定者，每學年至少應休畢規定之日數；未達應休畢規定之日數資格者，應全部休畢。休假並得酌予發給休假補助。每次休假，應至少半日。（第 2 項）前項應休假日數以外之休假，確因公務或業務需要經學校核准無法休假時，酌予獎勵，不予保留。…。」
三、次查公立中小學兼任行政職務教師休假補助基準第 2 點規定：「（第 1 項）兼任行政職務教師當學年具有 14 日以下休假資格者，應全部休畢；具有 14 日以上休假資格者，至少應休假 14 日，應休而未休假者，不得發給未休假加班費。（第 2 項）前項 14 日應休畢日數以外之休假，當年度未休假之日數不得保留。但因公務或業務需要經學校核准無法休假時，得由各主管機關酌予獎勵。」。
四、另查銓敘部 80 年 1 月 24 日（ 80 ）臺華法一字第 0511924 號函釋：「公務人員請假規則第 3 條第 1 項第 4 款規定：『因分娩者，給娩假 42 日……』此一規定係基於女性公務人員因產後身體虛弱，確需持續療養之事實而訂定，故不宜分段或延後申請。...女性公務人員既有生產之事實，自應核給娩假，不宜重覆核給休假...。」。
五、綜上，兼任行政職務教師 14 日應休畢日數以外之休假，當年度未休假之日數不得保留，但因公務或業務需要經學校核准無法休假時，得酌予獎勵；至其於學年終分娩之請假疑義，基於公教一致性，參酌銓敘部 80 年 1 月 24 日函意旨，兼任行政職務教師於學年終分娩，既有生產之事實，自應核給娩假，不宜延後申請或重覆核給休假。
