主旨：公務人員保障暨培訓委員會函以，考績（成）丙等事件之救濟程序，自民國 104 年 10 月 7 日起改依復審程序處理，請 查照。
說明：
一、依據公務人員保障暨培訓委員會（以下簡稱保訓會） 104 年 10 月 28 日公保字第 1041060456 號函辦理。
二、公務人員考績法規對公務人員年終考績考列丙等事件，既於其晉敘陞遷等服公職權利有重大影響，而得提起行政訴訟，則保訓會歷來所認應依申訴、再申訴程序提起救濟，即不再援用，自 104 年 10 月 7 日起，改依復審程序處理，俾使考績（成）考列丙等之受考人得以提起司法救濟。爰請各機關（構）於受理考績（成）丙等事件之救濟時，勿再依申訴程序處理，改依公務人員保障法第 44 條第 2 項規定，自收到復審書之次日起 20 日內，如不依復審人之請求變更或撤銷原行政處分，應附具答辯書，並將必要之關係文件，併案層送保訓會。
三、另各機關（構）於製發考績（成）通知書時，請注意該通知書之救濟方式教示內容，亦應一併修正。
四、檢附原函影本 1 份。
