主旨：教師原經核准利用公餘時間進修、研究，嗣後辦理留職停薪期間，得否再利用夜間或例假日從事進修、研究，請依說明項辦理，請 查照。
說明：
一、依據教育部 102 年 5 月 21 日臺教人(三)字第 1020076823 號函辦理。
二、查教育人員留職停薪辦法第 9 條第 3 項規定：「留職停薪人員於留職停薪期間，不得從事與留職停薪事由不符之情事；其違反者，服務之學校、機構或主管教育行政機關應廢止其留職停薪，並依相關法令規定處理。」
三、復查教育部 98 年 7 月 29 日台人（二）字第 0980114427 號函釋及 100 年 5 月 3 日臺人（二）字第 1000906491 號函釋意旨：
(一)98 年 6 月 5 日以前依教師進修研究獎勵辦法規定奉准進修者，嗣後辦理育嬰留職停薪者：准予進修至畢業為止(進修學分及其他非學位學分者，准予進修至課程結束為止)。
(二)98 年 6 月 6 日以後依教師進修研究獎勵辦法規定奉准進修者，嗣後辦理育嬰留職停薪者：准予進修至當學期為止，復職後始得繼續從事進修活動。

(四)教師已辦理學校註冊在家準備論文，視同進修活動。
四、爰上，教師原經核准進修，僅嗣後辦理育嬰留職停薪者，得依說明三之規定繼續進修，辦理他種類留職停薪者，不得再從事進修活動，違反者將廢止留職停薪之申請，並請學校依相關規定卓處。
