一、查教師請假規則第 8 條規定：「(第 1 項)公立中小學教師兼任行政職務者，應給予休假，其專任教師年資得併計核給，……(第 3 項)除初任教師外，於學年度中兼任行政職務未滿 1 學年者，當年之休假日數依第 1 項規定按實際兼任行政職務月數比例核給，比例計算後未滿半日者以半日計；超過半日未滿 1 日者，以 1 日計。……。」同規則第 9 條第 2 項規定：「因辭聘、退休、資遣、留職停薪、不續聘、停聘、解聘、撤職、休職或受免職懲處，再任或復聘年資未銜接者，依前條第 2 項規定核給休假。但侍親、育嬰留職停薪教師復職後於學年度中兼任行政職務者，依前條第 3 項規定給假，次學年度續兼者，依前條第 1 項規定給假。」
二、次查教育部 95 年 12 月 19 日台人(二)字第 0950179641C 號令略以，兼任行政職務教師有下列各款情形，年資銜接者，其復職或任用當年之休假，以復職或聘任前 1 年年終之休假年資，依教師請假規則第 8 條第 1 項所定日數，乘以復職或聘任當月至年終之在職月數比例後，於復職或聘任時起核給：……（三）曾任私立學校專任教師年資。
三、再查教育部 81 年 5 月 20 日台(81)人字第 26599 號函略以，銓敘部函釋稱公務人員請假規則第 9 條（按：現為第 8 條）規定所稱之「年資銜接者」或「年資未銜接者」應以原機關（構）出具之離職證明書之離職生效日期與新職機關（構）之派代令中之到職生效日期是否為同 1 日為認定標準，至於「報到日係星期例假日實際無法報到，其年資應視為未中斷，得准予併計休假」，其報到日是否屬「實際無法報到」應由新職機關根據事實認定。公立學校職員及兼有行政職務之教師休假年資之計算請比照辦理。
