主旨：所詢未兼行政職務教師於寒暑假期間因校務需要返校服務
或協助辦理各項工作，得否視同加班並於 6 個月內實施補
休疑義乙案，復請 查照。
說明：
一、復 貴校 102 年 6 月 24 日文化小人字第 1020698389 號函辦理
。
二、查教師請假規則第 12 條第 1 項規定：「公立中小學未兼任
行政職務教師於學生寒暑假期間，除返校服務、研究與進
修等活動及配合災害防救所需之日外，得不必到校。」爰
公立中小學教師寒暑假期間係「得」不必到校，非等同於
例假日，先予敘明。
三、本市公立中小學未兼任行政職務教師寒暑假期間返校活動
日數前經本局與教師會依「公立中小學未兼任行政職務教
師寒暑假期間返校活動事項及日數實施原則」協商之總日
數為二日至五日。復查教育部 96 年 10 月 2 日台人（二）字
第 0960147517 號書函釋，「本實施原則係規範全體教師共
通性返校服務與研究進修事項及日數。如非屬全體教師共

通性應返校服務與研究進修事項及日數，於寒暑假期間，
若有與教學相關事項或配合災害防救所需亦應到校辦理，
教師無法配合參與時，應依規定辦理請假手續。」依前揭
實施原則及函釋之意旨，未兼行政職務之教師於寒暑假期
間，因共通性返校服務、研究進修等活動、教學相關事項
及配合災害防救所需之日數，無法配合時應辦理請假手續
，故若非於例假日或放假日到校，自不生補休疑義。
四、貴校請示之疑義請依上開規定本權責酌處，惟若有參與教
學相關事項或配合災害防救以外之事由要求未兼行政職務
之教師返校時，宜納入寒暑假期間返校活動事項及日數實
施原則協商之二至五日範圍內實施，以避免爭議。
