一、查性平法第 2 條、第 19 條及第 21 條規定略以，受僱於僱用 30 人以上雇主之受僱者，為撫育未滿 3 歲子女，得向雇主請求每天減少工作時間 1 小時；減少之工作時間，不得請求報酬。受僱者為前項之請求時，雇主不得拒絕，且不得視為缺勤而影響其全勤獎金、考績或為其他不利之處分。公務人員亦為該法適用對象。
二、茲以公務人員為性平法之適用對象，爰現行公務人員如確有撫育未滿 3 歲子女之需要，得向服務機關申請每天減少工作時間 1 小時，服務機關不得拒絕，且不得視為缺勤而影響其相關獎金、考績或為其他不利之處分；至是類人員俸給應如何扣除，依銓敘部 95 年 6 月 14 日部法一字第 0952643849 號書函規定，以其當月全月俸給總額除以該月全月之日數計算出當月「日薪」，再以其當月日薪除以上班時數 8 小時，計算出當月「時薪」後，乘以當月所減少之工作總時數扣除之。
