主旨：請轉知同仁知悉有關「公務員使用會員卡採購公物，私吞累積之紅利點數，是否涉及取得不正利益」之補充說明，請 查照。
說明：
一、依據法務部廉政署 102 年 7 月 4 日廉預字第 10205014900 號函及臺南市政府政風處 102 年 7 月 15 日南市政預字第 1020618946 號函辦理。
二、近日媒體報導標題「廉署：採購公物 A 紅利點數也觸法」，內文刊載略以「公務員不是拿錢才出事，例如使用會員卡採購公務，『私吞』累積紅利點數，都算是不正利益，都有事」等語；惟刊登內容簡略，恐造成外界誤解，法務部廉政署特予函文補充說明。
三、有關公務員使用會員卡採購公物，私吞累積之紅利點數，是否涉及取得不正利益，非可一概而論，爰依「機關專責採購或經常辦理採購事項之人員」及「機關同仁因公務需要」二類情形說明如次： (一)機關專責採購或經常辦理採購事項之人員如長年以個人 信用卡或會員卡購物或支付各項費用，因非其個人購物 ，而是為機關購物或支付費用，所得紅利點數自應歸機 關所有，不能獨得。
(二)機關同仁如因公務需要，以個人信用卡支付款項，行政 院主計總處為簡化經費支付程序，曾明定機關辦理採購 及機關同仁因公務需要（例如：員工出差費），以個人 信用卡支付款項之處理原則，詳請參照行政院主計總處 96 年 2 月 1 日處會三字第 0960000691 號函說明六（如附件）。如公務員辦理因公出差旅費用等核銷，依行政院主 計總處前開函示意旨，自得以個人信用卡刷卡方式辦理 支付，並無涉有取得不正利益或違反公務員廉政倫理規範情事。
