主旨：教師於公傷假期間取得較高學歷得否改敘薪級疑義一案，

說明：
一、依據教育部 102 年 7 月 15 日臺教人(二)字第 1020096978 號函
辦理。
二、查教師請假規則第 4 條規定：「教師有下列各款情事之一
者，給予公假。其期間由學校視實際需要定之：…(第 6 款)
六、因執行職務或上下班途中發生危險以致傷病，必須休
養或療治，其期間在二年以內。…。」。
三、次查教育部 86 年 6 月 7 日台(86)人(一)字第 86049910 號函釋：
「查有關現職教師因留職停薪或帶職帶薪繼續進修，於
取得較高學歷後，得依『公立學校教職員敘薪標準表說明
』十規定【按：該點於 93 年 12 月 22 日修正後，合併於第五
點，爰予刪除】，於本職最高薪範圍內改敘薪級。至教師
如違反『教師進修研究獎勵辦法』之規定，自行前往進修
，服務學校或主管教育行政機關應本於權責另予議處。」
四、據上，按「教師請假規則」規定核給公傷假之意旨，係為
因公受傷教師休養或治療之需，教師於公傷假期間進修並
取得學位，核與公傷假之意旨未符，應更改適當假別登記
；若已取得學位，請依教育部 86 年 6 月 7 日函釋辦理改敘薪
級，並應審酌是否違反「教師進修研究獎勵辦法」規定予
以議處。
