一、按公教人員保險法第 34 條規定：「(第 1 項) 被保險人之眷屬因疾病或意外傷害而致死亡者，依下列標準，給與喪葬津貼：…… (第 2 項)符合請領同一眷屬喪葬津貼之被保險人有數人時，應自行協商，推由一人檢證請領；具領之後，不得更改。有協商不實，致損及其他被保險人權益時，由具領人負責。」同法施行細則第 45 條規定：「被保險人或其受益人請領各項給付，應填具請領書及收據，併同有關證明文件，送由要保機關審核屬實並加蓋印信或本保險專用章後，轉送承保機關核辦。」合先敘明。
二、茲因近年迭有公保被保險人因協商不實，即在眷屬喪葬津貼請領書中勾選切結事項，致損及其他被保險人權益，迭生爭議。為杜?類此爭議，銓敘部函示，如符合請領同一亡故眷屬喪葬津貼被保險人有數名時，應依上開公教人員保險法第 34 條第 2 項規定，由該等被保險人先完成協商程序，推由一人具領，自即日起，該等被保險人並應共同出具協商切結書。具領人填送眷屬喪葬津貼請領書應併附協商切結書，送由服務機關審核屬實後轉送本部辦理。嗣後如發生切結或協商不實情形，應由具領人負一切不利後果之責任，其他被保險人不得再為請領，應自行向具領人求償。
四、本部業已配合修訂眷屬喪葬津貼請領書(如附件 1)及協商切結書(如附件 2)報經本保險主管機關備查在案。
