一、臺灣地區與大陸地區人民關係條例（下稱兩岸條例）第 9 條、第 9 條之 3 、第 91 條修正條文，業經行政院 108 年 8 月 6 日院臺法字第 1080026109 號令發布。自 108 年 9 月 1 日修正施行之日起，有關兩岸條例第 9 條第 3 項及第 4 項所列人員（即臺灣地區公務員及管制赴陸之退離職人員等），進入大陸地區返臺後，均應依「赴陸人員返臺通報表」向（原）服務機關或委託機關通報。
二、通報原則如下：
(一)現職人員送交所屬機關（構）。
(二)機關首長送交所屬機關之上一級機關（按：本府所屬二級機關學校首長送交一級機關、一級機關首長送交本府）。
(三)直轄市長送交行政院。
(四)管制赴陸之退離職人員送交原服務機關（構）、委託機關。
三、另依兩岸條例第 91 條第 4 項規定，具有第 9 條第 4 項第 4 款身分之臺灣地區人民（即管制赴陸之退離職人員），如有依規定應通報而未通報者，（原）服務機關或委託機關得處新臺幣 2 萬元以上 10 萬元以下罰緩。
四、檢附本府暨所屬機關學校「赴陸人員返臺通報表」1 份，電子檔併置於市府人事處網站（網址：https://web.tainan.gov.tw/ethics/）「便民服務」項下－「其他服務」中供同仁下載使用。
