一、依據教育部 108 年 10 月 24 日臺教人(一)字第 1080149303 號函轉銓敘部 108 年 10 月 9 日部法二字第 1084863110 號函辦理。
二、旨揭選舉公告業於本(108)年 9 月 12 日發布，並將於本年 11 月 18 日至 22 日受理第 15 任總統、副總統及第 10 屆立法委員候選人登記之申請， 109 年 1 月 11 日辦理上開人員選舉投票作業。各機關(構)學校人員於選舉期間，應確依教育基本法及公務人員行政中立法(以下簡稱中立法)相關規定嚴守教育及行政中立。復依公務員服務法第 5 條及第 19 條規定，公務員應謹慎勤勉，且非因職務之需要，不得動用公物。又依中立法相關規定，公務人員不得為支持特定政黨或公職候選人，利用職權或動用行政資源從事相關政治活動或行為。
三、另依教育基本法第 6 條規定略以，教育應本中立原則。學校不得為特定政治團體從事宣傳或活動。主管教育行政機關及學校亦不得強迫學校行政人員、教師及學生參加任何政治團體或活動。……。請學校利用各種集會及相關教學機會，向教職員工生宣導民主法治及淨化選舉風氣之理念，
並不得從事有違教育中立及影響校園學習環境安寧之活動。
