說明：
一、依教育部本(109)年 2 月 5 日臺教人(三)字第 1090017849 號函辦理，並檢附原函(含附件)影本各 1 份。
二、查行政院人事行政總處 109 年 2 月 5 日總處培字第 1090025887 號函就旨揭各級機關（構）學校人員得申請防疫照顧假之規範，摘述如下：
(一)因應中國大陸新型冠狀病毒肺炎疫情嚴峻及國內防疫需要，嚴重特殊傳染性肺炎中央流行疫情指揮中心（以下簡稱疫情指揮中心）依據災害防救法第 31 條第 1 項第 11 款，決定全國高中職（含）以下學校延後開學，並規定於本年 2 月 11 日至 24 日期間，如有照顧 12 歲以下學童之需求，家長其中 1 人得請防疫照顧假，此假乃為防疫應變緊急處置之特別措施。
(二)基於防疫需要，各級機關（構）人員，於本年 2 月 11 日至 24 日期間有子女照顧需求者，除得依現行各類人員所適用之請假規定以事假（家庭照顧假）、休假或加班補休辦理外，如有照顧 12 歲以下學童之需求，家長其中 1 人亦得選擇申請防疫照顧假，各機關不得拒絕，且不得影響考績或為其他不利處分。
(三)又因新型冠狀病毒之傳播途逕及特性尚未明朗，疫情發展仍有許多未知狀況，為維持政府機關、學校及事業機構等運作穩定，申請防疫照顧假不予支薪。
三、據上，依疫情指揮中心公布全國高中職（含）以下學校延後開學期間，公立中小學未兼任行政職務教師於學生延長寒假期間，依教師請假規則第 12 條第 1 項規定，除返校服務、研究與進修等活動及配合災害防救所需之日外，得不必到校；另公立專科以上學校則依各校規定辦理。又依前述相關規定，各機關（構）學校教職員（含兼任行政職務教師）於本年 2 月 11 日至 24 日期間有子女照顧需求者，除得依各類人員所適用之請假規定以事假（家庭照顧假）、休假或加班補休辦理外，如有照顧 12 歲以下學童之需求，教職員亦得依前開規定選擇申請防疫照顧假，各機關（構）學校不得拒絕，且不得影響考績（核）或為其他不利處分，惟申請防疫照顧假不予支薪。
四、至私立學校教職員，依疫情指揮中心本（ 109 ）年 2 月 3 日肺中指字第 1093700056 號函說明略以， 12 歲以下學童之家長，若有親自照顧學童之需求，本年 2 月 11 日至 24 日期間，受雇之家長其中 1 人得請防疫照顧假，雇主應予准假，且不得視為曠工、強迫以事假或其他假別處理，亦不得扣發全勤獎金、解僱或予不利之處分，爰請各校秉權責依該函規定辦理。
