主旨：有關教師隨同配偶因公派赴國外工作留職停薪 2 年及延長
留職停薪 1 年，於期間屆滿之次日復職，得否於復職當日再
以同一事由續請留職停薪疑義一案，復如說明，請 查照
。
說明：
一、依據教育部 102 年 8 月 14 日臺教人(三)字第 1020116031 號函
辦理。
二、查教育人員留職停薪辦法第 4 條第 2 項規定：「除校長、社
會教育機構及學術研究機構首長外，教育人員有下列情事
之一申請留職停薪者，服務學校、機構或主管教育行政機
關得考量業務或校務運作狀況依權責核准：...七、配偶
因公派赴國外工作或進修，其期間在 1 年以上須隨同前往。
」同辦法第 6 條第 1 項規定：「留職停薪人員除其他法律另
有規定外，應於留職停薪期間屆滿之次日復職。...」次
查銓敘部 95 年 10 月 27 日部銓三字第 0952711374 號電子郵件
釋示規定：「一、...本辦法於 91 年 7 月 1 日修正發布時，原
第 5 條有關申請留職停薪之次數限制規定業已刪除。準此
，有關公務人員可否於留職停薪期間屆滿復職後，再以同
一事由或不同事由接續申請，宜由服務機關參考上開規定
及考量業務狀況並依權責辦理。二、依上開規定，公務人
員延長留職停薪期滿應於期間屆滿之次日復職，倘擬接續
申請留職停薪，應俟回職復薪登記後，始得再行辦理同日
生效之留職停薪案件，惟仍宜由服務機關參考上開規定及
考量業務狀況依權責辦理。」
三、承上，審酌教育人員留職停薪辦法亦同公務人員留職停薪
辦法，並未就申請留職停薪之次數設限及相關限制規範，
基於公教一致性爰依上開銓敘部 95 年 10 月 27 函釋規定，教
師擬接續申請留職停薪，應俟其回職復薪登記後，由服務
學校考量課務狀況並依權責審酌是否同意，其辦理同日生
效之留職停薪案件。
