主旨：教師申請延長病假及扣薪事假(或扣薪家庭照顧假)期間，因未從事公務，與進修服務義務規定意旨不符，爰不得計入應繼續服務期間，請 查照。
說明：
一、依據教育部 102 年 8 月 19 日臺教人(三)字第 1020120191A 號函辦理。
二、查教師進修研究獎勵辦法第 12 條第 1 項規定略以：「教師...留職停薪全時進修、研究者，其服務義務期間為留職停薪之相同時間。」次查教師請假規則第 3 條第 1 項規定略以：「（第 1 款）教師之請假，依下列規定...事假及家庭照顧假合計超過 7 日者，應按日扣除薪給...」
三、按公務人員保障暨培訓委員會 102 年 8 月 5 日公訓字第 10221606651 號函：「...有關服務義務之規定，係為期進修人員能將進修所學，貢獻於機關之業務推動，俾提升政府施政品質。有關自行申請全時進修留職停薪人員，於回職復薪後履行服務義務期間請延長病假，茲以其於延長病假期間並未從事公務，與前揭規定意旨不符，爰不得計入應繼續服務期間。三、...倘因請假超過公務人員請假規則之規定日數，雖已依規定扣薪，惟基於前揭服務義務規定之立法意旨，該超過日數亦不得併計為履行服務義務之期間。」
四、衡酌教師進修研究獎勵辦法第 12 條，有關教師留職停薪全時進修服務義務期間，與公務人員留職停薪全時進修期滿者相同，教師申請延長病假期間及請假超過教師請假規則第 3 條第 1 項第 1 款規定之扣薪日數，均未從事執教工作，為期進修教師能將所學新知識，貢獻於教育學子，俾實現原進修計畫之教育理念，爰應配合前開公務人員保障暨培訓委員會 102 年 8 月 5 日函釋意旨，一併就教師服務義務期間為旨揭釋義規範。
