一、為確保公務人員依法行政、執行公正及政治中立，公務人 員行政中立法第 10 條明定，公務人員對於公職人員之罷 免，不得利用職務上之權力、機會或方法，要求他人不行 使投票權或為一定之行使。公務員服務法第 6 條及第 20 條亦 規定，公務員應公正無私、誠信清廉、謹慎勤勉，非因職 務之需要，不得動用行政資源。是以，公務員於公職人員 罷免案進行期間，應嚴守行政中立精神，避免利用職權或 職務關係、動用行政資源或使用職銜名器從事支持或反對 特定罷免案之相關政治活動或行為。
二、又各機關首長或主管人員負有管理責任，於選舉委員會公 告公職人員罷免案宣告成立日起至投票日止，請禁止政 黨、罷免案提議人之領銜人、被罷免人或其支持者基於宣傳、造勢或拜票等意圖所為造訪活動，且應於機關學校固 定辦公或處理公務之場所各出入口明顯處所，張貼禁止支 持或反對罷免活動之告示，以維政府機關行政中立之公正 形象。
